What's your take on this situation?
 
I bought a fishing rod. One of those Ugly Sticks with a Shakespeare reel. $39.99. I also bought a silver minnow for $4.99. One of the ferrules had a chip in it which abraided my line. Every third time I reeled it in the line would snap. So I lost that silver minnow and called it a day. Would you:

1) Refund my money for the rod and silver minnow

or

2) Refund my money for the rod only?

I some how think the store would at best replace the rod.
Consequential loss is never an easy thing for retail.

Ugly Stick has a good warranty, they should swap it out for another rod.

The store gave me a refund on the rod but refused to give me a refund on the silver minnow.

I think they should have given me at least a new silver minnow just to keep me happy. These rods go on sale every other week for $29.99 anyway and their cost on that stupid lure is stupid cheap. Like pennies on the dollar. Why destroy trust when it costs you almost nothing?

You bought the rod assuming it was in good order (though you do have some responsibility for inspecting before purchase, I mean c'mon). How you chose to use it was your decision, not theirs. The only injury was ambiguously attributable to the defect, which could have been due to the manufacturer, the store, your own negligence or your own cupidity.

Had I been the store owner I'd have accepted the rod and exchanged it if it didn't look like it got slammed in a tailgate. I might've offered you a discount on some lures (but not at a loss) if I liked your attitude or you were a frequent paying customer. I wouldn't give you a replacement lure unless you spent an extraordinary amount of money in my store.

I'd exchange the rod and give you another one.

Lures go away all the time, but you could ask them to replace the lost fishing line AND the lure...

If the line broke every third time, how many lures did you loose after the silver minnow went?

I wouldn't expect it to. How do I know that you DID lose the silver minnow lure? How do I know that you didn't lose it some other way?

In your single case, yes. Take 100 cases and the loss might be more. Take a thousand and I think you can see where it is going.
