Micheal Bloomberg and smoking...

I don't even smoke, but I see this law as wrong -- landlords and condo boards will be pressured to explicitly ban smoking, rather than say "we allow a vice." The guy is 70+ years old and has been mayor for 3 years longer than a term limit that he bribed his way into overturning allowed. Hope he finally resigns gracefully in 2013. He's getting way too old, senile, and controlling to be mayor of NYC:

The private jet he takes down to his spread in Bermuda most weekends emits plenty of smoke.

Why does the thought of Bloomberg frequently crossing the Bermuda Triangle in a small plane not bother me so much?

I have (mild) asthma, live in an apartment building in Manhattan and yes, occasionally smell neighbors' smoke. Of all types

If the minor odor of smoke is gonna kill someone, they should move out of NYC -- a bit of smoke from smokables is insignificant compared to diesel exhaust, smog, street food, etc. NYC is dirty, freely admitted. If you don't dig that, get out.

What's he dictating exactly? The rule makes building managers specify in their leases whether they allow smoking or not. It doesn't ban anything.

That was my interpretation as well.
Even if it has the effect of eroding the smokers unquestioned ability to engage in their (our) particular vice,whenever and wherever they please, the benefit to the non smoking crowd is much greater.
Personally, if I were looking to buy or rent a place in NYC, I would place much greater value on a building that did not allow smoking.

Not I. I don't allow people to smoke indoors. But let's say I went away for two months and sublet my apartment (BTDT). The tenants smoked indoors. I'd be facing a fine from the management as well as an expensive laundry bill. No thanks.

Then don't move into a building that does not allow smoking. Problem solved.

I have a rental property. The lease clearly specifies that there is no smoking in the house or on the property. I have made it clear to both of my tenants that if I smell smoke in the house or see butts on the property they will be looking for a new home. It is their choice to live there. They know the rules. I do not see a problem.

Until you buy in a condo or co-op building and they change the rules on you. And before you say "buy a house", remember that the majority of housing in Manhattan is either condo, co-op, or rental.

And that's you. When smoking was allowed and they had a smoking or non-smoking section, sometimes I would just get whatever was there first because I didn't want to wait. Some may accept it if the rent is right and some might not. Let the buyer choose for himself/herself.

So that is your fault. You should have specified it in the agreement or screened them better.

What more choice do you want? You have a policy laid out in black and white, you can sign it or say "Thanx but I'll pass". When I signed a lease, I could choose to find an apartment that allowed dogs, allowed certain weight of dogs or allowed no dogs. It was my choice to go to whatever building I wanted. Hell, you are not even chained to the city, state or country. You can go wherever you please.

As long as people are going to ask the govt to take care of them as a safety net, they are going to lose some rights. You want to have Mom & Dad as your safety net, you are going to have to live on their terms. That is why I prefer to say "Dear Govt, please do me a favor and DON'T do me any favors". People want the benefits much like people want the freedom to order the most expensive dishes at the top flight restaurants but they balk when the bill comes.
