got an estimate on my damages....

Well you are all gonna freak out on this, but one bodyshop, gave me an estimate for a whopping $6052.00!!!

The guy's insurance company has admitted full responsibility, so now its a matter of getting my estimates together, and letting em faint at the sight of the estimates.

That doesn't even include a rental mercedes, which I am getting estimates for today.

repaint whole car. custom paint, can't be matched properly.

Question

I doubt that guy will ever hit someones elses car in a parking lot ever again, but if he does, he'll probably hit the road this time instead of the golf course!!

ps I am curious, what would you have done differently had he come to you and told you before-hand?

This topic made me think..

the paint on my car is really good, except for the front due to bugs and small rocks. If I were to catch someone opening a door at a parking place and it either denting or scratched paint off the door, would I be able to do anything or they wont due to the fact the car is 14 years old?

well if you catch someone damage your car, they are in most cases liable to repair the damage.

I wouldn't purposely go out and look for it to happen, its a hassle to deal with.

I hope I am lucky enough to get paid out in full, they may make an offer, and if they do I will have to decide on if I think its fair. of course the estimate has not even included a rental car.

fwiw- heard these tidbits via the grapevine (state of CA)....:

>if the damage is over $5k= outside the Small Claims Court jurisdiction
>if the damage is under $5k =within the Small Claims Court jurisdiction

>if the damage is not a direct result of 'gross negligence' (of the defendant)- the (dent/chip/scratch/paint,etc.) damage is commonly accepted as (associated with) the 'wear and tear'/ normal inherent risks of vehicle use in public (aka- not generally liable)

>insurance companies (on either side) will commonly not cover these 'minor' dings/ dents/ scratches (gratis); but they are bound to perform according to the insurance contract (if damage is over the deductible & deductible paid/ within coverages of the insurance contract)

>damage to other vehicles caused by a child (under 18 years old/ absent intent- ie vandalism/michief) & not a result of parental 'gross negligence', is commonly accepted as (associated with) the 'wear and tear' normal inherent risks of vehicle owhership (aka- not generally liable)

>there may be case law, specific insurance regulations, etc. that may contain more complete guidance

Little dings and dents to vehicles happen with use- - naturally related to road/ highway velocities, dirt, UV, weather, parking traumas, natural elements etc.- - so owners really can't help but accept the results of folks exiting cars parked closely next to each other... too

We've all sadly observed brand spanking new cars fresh out of the sales lot with minor and major damage...
