Hey guys... 92 sel 600... GONE!!!! sad story.

Hey guys, I enjoyed this website and the little get togethers we had but sadly today in Hayward california myself and 5 other cars were slammed into by a drunk driver heading towards us at over 70 mph. He clipped a car in the intersection which then hit a hummer and the drunk drivers car slammed into 2 cars before slamming into the front of my car. No one was hurt surprisingly, but my car looks like it's totaled. Sucks as I had some good times in that car and met some good people during the time I had the car. Just wanted to let you guys know.

Thanks for the memories.... below are some pics of the car.

Your poor car is truly smashed. I'm sorry it happened, but glad that all are OK. However, it's too bad the drunken SOB wasn't put out of his misery. Where is the justice?

Will,

Sorry to hear of your loss. Hope you are okay. Looks like the passenger cell is intact so the crumple zone feature works. Assume the dog was not along for the ride.

There has to be another 140 with your name on it.

Yea not only was the guy drunk but he had to be on some kind of drugs. He got out of the car and was screaming how fun that was. And mumbling some weird things, he ran out in the middle of the street and layed there. Finally the police got there and had to tazer him and take him to jail.

HOpefully his insurance company will take care of a rental car and give me something decent for my loss cuz the car i would imagine has to be totaled.

All this like 5 weeks before I graduate from college. What a great way to finish.

Wow, that is so sad ... but impressive how untouched the cabin area is. Looks like your poor MB did it's job in a scenario we all hope we never face.

If this had been me, I probably would have swiped the taser from the cops and taken a few extra zaps at the drunk. That's terrible. Accidents happen, but this one did not have to ... lucky no one was killed or hurt badly.

Sorry to see a beautiful W140 ruined.

Yea I know a lot is still sinking in. I can feel my leg is sore and I'm sure theres going to be a dark bruise their tomorrow. I know it sounds like a dumb question but should I go to the hospital tomorrow just to check everything out? I don't have any medical coverage right now (26 yr old college student) Is it worth it to check it out? Also anyone that knows or has had this happen, how does getting a rental car work from his insurance company?

Thanks for all the responses.

Yes. I am a huge skimp on money, but you should definitely get checked out. There are a lot of things that can happen physically that you may not even notice but can haunt you down the road ... neurological injuries or even torsion-related bone bruises that can lead to avascular necrosis. Hopefully you'll just end up with a clean bill of health and a pesky bill of expenses. Any medical expenses you incur are probably material for lawsuit against the drunk, I would think ... but my knowledge of law is pretty meek. Either way, get it checked out. It will cost you a lot more if something's wrong and you don't treat it right.

Good luck.

I think your back hurts too...

You have a personal injury case. The settlement could easily pay for a replacement car.

Will- sorry this happened but at least you were able to walk away from it! There is another Benz around with your name on it somewhere I am sure. Just because you are Benzless for awhile doesn't mean you can't stay on the Forum.

Ouch!

Sorry for your loss. And the PIA steps you have to go through to to get what's coming to you.
You do need to get on this now. First, in person, talk to your insurance company to arrange a rental and to see a doctor for your injuries. I feel phone calls do not accomplish good enough results.
Long term or short, get checked out. They will tell you the $$ figure to get a rental. You pay nothing. His insurance company is obligated.
Second, find out what your car is worth to you. Collect all the repair receipts including the cost of the tires together.
Get a copy of the police report from the police yourself. And keep it.
Search the market for another car JUST LIKE yours. How much will it cost to get it. Narrow your search to one with like mileage and visual condition.
Make copies of everything because at some point down the road, you will have to settle.
Remember this. The police report proves fault. And his insurance company is obligated. They will, however, try to low ball you to sign a settlement.
That's where the paper work you have comes in handy. Reports. Receipts.
Doctor expenses. Pain and suffering.
Demand and do not be shy.

If you were here in Australia you would need to go through your own insurance company. If the driver of a car at fault in a crash car is guilty of a crime - i.e. drunk or drugged driving then his insurance will be null and void. I don't know how it will be in the U.S.

I would definitely let your insurance company handle everything. You don't want to get messed around in this, especially since a crime is involved. It maybe messy enough, you needing to do police statements and go to court etc. - A huge amount of precious time involved in this.

Always a bummer to see a great car like a W140 especially a flagship 600 go down like this.

Sorry about your loss and I'm glad you're mostly OK physically. I don't know about the medical thing though. To get a decent test/diagnosis, you'll probably have to do some scans and those things can be terribly expensive, especially without insurance. It's up to you but if it were me I'd see how I feel a day or two later and if it doesn't hurt much, I'd forget about it. Certainly do go after the guy's insurance for your vehicular damage, no question there.

you'll want to talk to your own insurance about PIP. They'll cover % of health, lost wages, etc. In Florida, at least, this is for the first $10,000. I think you can sue for the percentage that your insurance doesn't cover.

I wouldn't use my own insurance unless necessary. Your rates may go up. It should always be the guilty party's insurance, or the guilty party itself, reimbursing everyone else.
