I really don't want to pick a fight with you, but I have made a pointed effort to be absolutely sure, as a legal liability issue, that I'm not in violation of any statutes, federal, state or local. I work on a contract basis with some lenders directly, and others through clearinghouses that assign field chase assignments. All of these parties agree that we are in good shape from a legal standpoint. The main thing to be careful of is 3rd party disclosures...can't divulge anything to anyone but the debtor.
I respect your distaste for this sort of work and can see why people wrinkle their noses when I tell them what I do. These are not small, shady lenders though, and even though I feel that I'm on solid ground legally, I doubt these large lenders would use my services if they didn't review the legalities and weren't secure in our legal footing.
The FDCPA notes several no-no's such as profanity, disturbing the peace, and threatening something you can't make happen, such as saying if you don't pay today we'll repo the car, when it's not my decision whether or not to pull the car.
