How so? Prison is also a penalty. Fines are also a penalty. I don't cheat or steal because I don't want to go to prison. You looked at me funny this morning and I wanted to hit you. However, the fact that you might call the cops and have me arrested makes me think twice. The list goes on. Lets face it, any penalty will not deter everyone. But that said, it deters most. Somebody will always figure out they have an angle that will work.
Another affected party might be the victims family. You killed my son, wife, etc, etc. Now you are going to swing. You bet it will make me feel better. Won't bring my so and so back but it is revenge. If not, I would have appealed against the penalty at your trial.
On that note, What about the speeding penalty? Who is affected by my speeding? Nobody died. Would you be for the speeding penalty ONLY if someone died too? What about other fines for other offenses?
