Just because someone shoots you does not automatically mean that you or your heirs will win a suit. In fact, if he doesn't get any criminal charges, you probably won't find a lawyer to take the case.
People get shot all the time without criminal charges being filed. All that needs to happen is that the shooter be afraid for his or someone else's life.
