Constitutional rights and protections apply to citizens of the United States of America and under most circumstances, to aliens who entered the USA legally.
The right to face one's accuser in American courts is a constitutional right.
So, if the person is a citizen then I think he should have his day in court. If he is an alien then his particular circumstances become important, don't you agree?
