In this state (California) and probably others you are responsible for your speed whether you have a speedometer or not and whether it is working correctly or not. You might get a sympathetic judge to throw out such a charge, depending on the circumstances.
Oh yes, you're also required to have a speedometer in the car. When my 87's was out for odometer repair (I sent just the speedo unit, protected the needle by taping a small box over it) I mounted my GPS on the dash, used it as the speedo. Whether a cop would have accepted it is another question, but I never got to find out.
