Blown '99 e320 tranny (V6)

Daughter had car up at college, called with the wonderful news that it stopped moving. Too far away for me to tow home so contacted local AAMCO.
The tranny is blown, both gear sets, one probably failed and took the other out with it.
AAMCO said they see maybe 2 or 3 out of 10 repairs on this model being such.
Does this sound right?
The replacement ($3K, 12mo. guar) is supposed to have updated gearsets that address the issue.
If this is true, was there a recall on this?
Any chance of me getting compensation from MB?
Or was I just unlucky?
