Well, in a certain way, we have to, in order to be on a higher ground with them and not sink to "their level".

If we didn't give criminals/prisoners of war & enemy combatants/terrorists rights trial rights as accused criminals and just lopped their heads off, we as a country would be no better than any two-bit military dictatorship throughout the world. I don't think too many citizens of the U.S. want to go that route.
