1) i don't believe that there's any state that makes it a requirement the both parties file claims to settle one party's claim;

2) You likely do have a remedy to bring a small claims action for the recovery of your deductible,

3) Contact your state's insurance regulator's office to verify what your rights are and if the regulators can intervene on your behalf if their claims adjustment practices are in violation of law.
