Could also lay at the feet of your ISP. Mine has a large bank of 56K modems and when those are all tied up the system diverts to the 32.6K bank then to the 28.8. Sometimes I'll connect at less than 45K so I'll disconnect and retry, usually snagging a 56K. Could also be in the phone cable or your modem as has been suggested. Try logging off and on see if you connect at greater speeds.
