Check your own insurance to see if you have "uninsured or underinsured coverage", we have that here (NB Can), and it is mandatory. If the at fault party doesn't have enough insurance to cover the damages, your insurance company does, and chases the other guy (who will may wind up in the assigned risk pool, the same as a driver with a DUI on record. Sucks to be them.)
