Lets not make it so complicated. It is complicated enough as it is. If you want to call it murder, certify that is is alive using the current standards the doctors use to declare death. It fails, it isn't alive and your point is moot. If it passes, it is alive and we can discuss whether it is covered by law or not,etc, etc. It has to be alive before it can be killed unless you consider removal of a wart or tumor murder.
