I don't disagree with pressing charges.
If you turn it into your insurance company they will pursue the matter with the DB's insurance company. If he is uninsured it should be covered under comprehensive since you were not driving when it occurred. A comp claim will not impact your rates I don't think.
I always carry five hundred deductable on collision and one hundred deductable on comp. the lower deductable on comp is almost free and the larger one on collision really saves some money.
