Innocent until proven guilty has a nice ring to it. Try being identified by several eyewitnesses. At the time of the crime you where home alone watching televison.

We all have look alikes that are almost dead ringers out there somewhere. There is also the issue of dna evidence clearing some people that have been incarcerated for a long time that occassionaly arises. There is no doubt they were innocent.

What also bothers me is why once it is conclusivly proven they were innocent. They are not released from prison right away.

Evidence in your favour can be blocked from use in pre trial hearings by technicalities as well. I am little versed in the legal system but know of one serious attempt to block absolute evidence in one case.

The serious attempt was to eliminate it from the trial based on the police not collecting it. Instead the individual himself had. Some public pressure was brought to bear when this was going on. Otherwise they may have gotten away with it. With out that evidence being admitted he would have been convicted. He should not even have been charged. His legal bill was forty thousand. No practical recourse for that.

As it was he and his family had to move away because too many people feel that once charged you must be guilty. They not knowing the details of the case. It presents a stigma to some degree in serious cases just being charged and going to court.

The french invented the justice system. In some ways I find that system prefferable. Or if I was innocent think I would have a better chance under it.
