If they want to pass me and move on I have no issues with it. it does irritate if they pass then slow down once in front.

Question:
How did you not observe BMW's fast rate of closing in your rear view mirror? Where'd he come from? Were you on a 2 or 3 lane hiway? Even on a three laner I think he could have been seen in the rear view mirror closing up fast or lane jumping. I always try to monitor what's behind me as much as what's ahead, if not more so, depending on the circumstances.
In similar circumstances, I try to make sure the gap is closed before the DB gets to my 3 oclock, so there's no doubt in his mind he can't make it around me. Always watch your six.
