The last court of appeals is the Texas Court of Criminal Appeals. There are nine Judges, seven of them are Republicans and most of them are Tea Party types.

They love DeLay because he was doing all he could to make sure the right people got elected, so one one expects them to rule any differently that the other Republican controlled court just did.
