Needs to be prosecuted as attempted murder when it is not prosecuted as murder. Even if doesn't kill outright it could later lead to a stoke or other cause of death.

Also justifies deadly force in defense.

Take someone with a history of strokes in the family and whack them in the head it is absolutely, positively, attempted murder.

A whack in the head is a time proven method for killing an animal. Even an animal larger than a human.

You see someone go unconsious and abandon them? That should be good for many years in jail even if you didn't hit them.

One of the disturbing things about this is it leads to wishing harm to young people, even if they are young thugs. Being put in this position should be resented.
