I thought in His case it was time not served.
I think the fact that He kept out of trouble is more important then sending Him to Jail. There is a mound of evidence to show that People who go to Jail end up back there many times. He was able to break that cycle.
I think there is a bunch of options like probation for some extended time. But at the end of the article it said there was a precedent and the Man in that case was set free.
Another way to go if they are still around would be to see if the Person or Business He committed the Crime against is willing to drop the Charges.
