You are confusing several sets of facts.
The biggest confusion is between the state acting in a legal manner or not. If laws are on the books about how the state can execute someone and those laws are broken then the facts will bear this out.
If we are good with the state just hauling off and killing people in any way they find fit then why not hunt the condemned for sport? This is one of the punishments the British King enjoyed handing out and is one of the reason our Constitution forbids cruel and unusual punishment.
