I'd make a deal with the seller:

We will connect a 1 gallon fuel tank to the car, use GPS to measure a steady 55 mph speed / distance covered. If the car gets less than 40 MPG, I get the car for free. If the car does get 40 MPG or greater, I will pay 2x for the car.
