The variable valve timing on the M104 engine is only on the intake cam and is a 2-position deal. I believe the 2 positions are no valve overlap, and 30 degrees of valve overlap. Which position it takes is dependant on engine rpm. It takes the overlap position in the mid rpm range around 2,000-4,700 rpm, but don't quote me on that. But it is not an infinitely variable system like the current BMW VANOS and only changes the intake cam in relation to the crank. I have not heard of problems with it before.
