I've had brake lights fail and THEN be in a failed state immediately after because even the REPLACEMENT switch was NFG. Make sure that the brake lights work, sometimes the switch will fail and they work fine, other times the brakelights aren't even working. SCARY.
If the shop you brought it to can read out the fault code(s) in the ESP control module, they should be able to shed light on what's going on.
The advice on the battery does hold water too, seen this a number of times also.
Other possiblities that come to mind is a wheel speed sensor (basic ABS stuff), a steering wheel angle $ensor, or a BAS problem (problem with the travel sensor in the brake booster).
