Definitely a grey area there, I agree.
But I think anyone taking something that is not obviously a "survival item" (food, water, medical supplies, etc.) should be shot on site.
These looters taking TVs and stereos and computers and guns at a time like this, when they should be helping their neighbors, are among the lowest form of opportunistic criminal vermin.
