Exclamation To Buy Or Not To Buy

http://cgi.ebay.com/ebaymotors/ws/eBayISAPI.dll?ViewItem&sspagename=ADME%3AL%3ARTQ%3AUS%3A1&viewitem=&item=270042917205&rd=1

as some of you remember i won a 300 turbo off ebay. im kinda a little hesitent to continue with the sale. the car looks fine. i havnt had it shipped yet. a member here gave my a car fax from the car. it says it changed owners 3 times and has been in 1 car accident in 1994 and somthing about the odometer being inaccuret. and faild newyork emmisions last time

what else is new with the odomter. they almost always break. emissions i could care less abou cause in illinois they dont test diesels for emmisions. the guy told me it was owned by a little old lady since new. but the carfax proves to show otherwise. it could have been passed down in the family however just like my 240 was.

so i dunno, im kinda uneasy about this i dunno y. above is the link to the car. tell me what u guys think. the car i won for 750. and shipping is going to be about 500-600. that because he wants them to pick it up were he is at. which is like and extra hundo or so.

should i tell him to drive the extra 50 miles to drop it off at the truck station? he said that i could pay for the rest of the car when i got it. just give it to the truck driver? or somthing like that.

let me know. i gotta make a decision fast

Tell the seller about the car fax inconsistency and see what they have to say.

Unless there is some kind of serious misrepresentation, your bid is a contract to buy. But, that aside, this past summer we saw record 300D prices. That car would have likely been bid up past $2500, just with the word biodiesel mentioned in the ad. The price seems fair even for a parts car.

Sounds like you got a fairly reasonable price for shipping also. Heck, I once spent over $400 to ship a vehicle from NJ to PA. If you don't like the car, throw in a cheap veggie oil kit, and relist it. You'd probably double your money!

Looks good for $750

I'd give $750 for a parts car......looks pretty good for a parts car......why not just go and drive it home?? It's not just an e-Bay purchase, it's an adventure!!

Here's one a little bit closer to you 200041689800

In all seriousness, your bid is a contract to buy. Unless the seller is amicable, you'll probably be on the hook to buy.

Unless the car was misrepresented that car is yours.

Cut your losses...I'll give you $500 for it.

It is up to you to ask me any related questions.Thanks.

that is what he said. i know its a contract to buy. however he withheld info about the car. so i dont know.

it just all seems fishy. he is not a registered user anymore for ebay. whats that
all about?

also he said to use bidpay when it clearly says in the auction he prefered paypal. so i had to set up a whole now account for bidpay

granted 1300 is not alot to pay for a car. but it is alot of money to be thrown down the toilet if the seller dosent come threw. yes it is a legal contract, but what if the guy dosnt come threw? and i never recieve the car?

Yeah- I like the way ebay works: If you are the buyer, your bid is a contract to buy. If you are the seller, and the bids aren't meeting your expectations or you get a better offer on the side, you can pull out, sounds fair doesn't it?

$750 doesn't sound bad, but after shipping you could get burned. I don't have any good advice, but if you can catch the guy in a lie or misrepresentation, I would walk. It's too late after the "goods" are dumped in your driveway.

Rick

he did lie.he said it was driven by an old lady since new. and its had 3 owners. also it was in a car accident which he left out

the good thing is i dont have to pay for the rest of the car until i recieve it from shipping. im just suppose to give the truck company the rest of the money that i owe from the car once i recieve it.

so far i only have 150$ sunk into it

So, it's your call. A material misrepresentation of the facts of the sellers part voids the contract. There is no "meeting of the minds". You acted in good faith, he didn't.

Not a bad looking car, but it is impossible to determine condition on a rust belt car from ebay pictures, the underside could be eaten badly. The broken English in the ad also would make me cautious, if this car had been in the family for multiple generations, I'd expect a little clearer actual description instead of all the copied generic car info-does he have service records? That way you'd at least have some idea how it was maintained (and even possibly a contact/mechanic that might be able to tell you more about it's condition)-fleabay makes me nervous on older uninspected cars (that always seem to be 1000 miles or more away!). Good luck.
