ML320 transmission stuck

hi!
Im owner of ml30/1998..
this morning when i start the car, the transmission couldnt be moved from P position? No matter what i tryed.. after 1 minute of car running, the problem was gone and shifting worked again... ?!

Also, after reading some posts about transmission problems with ml320 i discovered that switching on ml320 (1998) shouldnt even be possible without pressed BRAKE pedal.. I tryed and i can shift it easy without holding brake.. Is this something wrong?? What do i have to consider to replace!

thanks a lot for help!! please let me know what should i change to avoid further damage since i totaly fall in love with this SUV and dont want to change it yet.

do a search here on `STOP LAMP SWITCH`

I'm taking my C240 into the shop Fri. because it wouldn't shift out of park, when I tried a second time and it shifted I had a MALFUNCTION display on the computer. Also got a bulb warning leading me to believe it is a situation with my brake light switch.
