This One Should Settle

December 17, 2004
KLAMATH FALLS, Ore. - A paraplegic man is suing Daimler Chrysler Corporation after he was burned when the heated seat of his SUV malfunctioned. Matt Beller, of Klamath Falls, filed the suit this week in U.S. District Court in Eugene. He is seeking over $14 million.

Beller was in his 2004 Jeep Grand Cherokee when the temperature of the driver's seat climbed to more than 150 degrees one day last February.

The ex-Marine says he has no feeling below his chest because of military injuries. He says he didn't know he had been burned until the next day.

He underwent skin graft surgery and had to lie on his stomach for three months.

Chrysler spokeswoman Mary Gauthier in Detroit said today that the company could not comment on the lawsuit without seeing it.

Wow, poor guy.

You'd think he'd have wondered why he was smelling barbeque all of a sudden.

On the other hand, those heated seats sure are nice in the winter.

NOW WHAT, another warning label in the future:

WARNING: Vehicle Occupants With No Operating Nervous System In Their Buttocks Should Not Use The Electrically Operated Seat Heater

You mean you don't have that message on the back of your sun visor? It's right after the one that says "Warning: testicles may be burned by driving with hot coffee"

Here in Hawaii . . . we always have heated seats, especially those black MB-Tex ones . . . they should be used as solar collectors!

I wouldn't have purchased a car with heated seats if I couldn't feel the heat.

Oooo, good point, Kuan. MB can always argue that the guy had no real reason to turn on the seats. Not that it'll hold up, but assume the guy bought it used (or the heated seats were part of a package he wanted, or got them to add to the resale value, or maybe it was a loaner or demo he got a deal on), what REASON did a guy with no feeling in his lower body have for turning them on? Unless he was shivvering or something like that which "told" him he could use the heat, I suppose things like that happen, a person can't be too fast to judge I guess.

You know I thought about that after I posted. I should have added that I wasn't saying the guy should have done this or shouldn't have done that, fact is the seats malfunctioned.

It also had to have been a modified vehicle. Who knows what that did to the AAM, or whatevever Jeeps version happens to be.

Why would it have to be a modified vehicle? Lot's of vehicles have heated seat options. Maybe that's why it had heated seats, maybe he wanted power and leather seats and you had to get heated seat option to get both of them.

Modified because he can't use the pedals with his legs.

Oh, I didn't read "paraplegic", I just assumed "no feeling" meant the nervous system, not use of the muscles and that he probably had some sort of therapy to be able to use his legs to walk and drive and such. You could be right though, maybe it's hand-controlled modified, but yeah shouldn't affect the seat heater either way.
