Beating speeding ticket.?

Okay..friend leaves my shop 10.00 pm in his 1984 VW GTI...clear, warm, dry nite....arrives back here as mad a wet hen at 10.45 pm.

Stopped by local cop in a city car, on the I-35 Interstate at mile marker 93.
Cop says "........doing 85....I paced you."

Friend say 'No way.....doing maximum of 80...."

Cop writes ticket for 'Pace'....' 85 mph'.....'$115.00.'

Question........Being a city patrol car...speedo not calibrated....
Cop said he did not use radar gun.

Our city police dept' get $15000.00 per year to patrol I-35 between 91 and 95 mile markers.

Seems we either got too many cop cars or we are short of cars patrolling the city...Which is it ?

David want's to know how can he kill the ticket....he has one for 95 mph on I-35 two months ago by OHP.

I advised him ask for jury trial and delay hearing.
What you think he might do ?

Go for the jury trial and hope the cop doesn't show up is his best chance. If not, lie like hell and fight it. What was the limit? You do realize that the cop can write pace or just visual and be assumed to be sorta accurate so there might be a fudge factor. Like the lawywer who helped me with a lying pig who said I was doing 95 in a 55 when I was doing 75 "I don't care if you are innocent or guilty. When we go to court, I say you are innocent." Got it knocked down to a 65 in spite of the pig showing up. When in court, make like a rug and lie like hell.

Sometimes, descretion is the better form of valor. Not always wisest to stick your head up and get it shot off. I think the Chinese army or some army used to do the human wave thing to overrun tanks. Brave but not a good idea if you get shot.

Well, mr hothead can bring to question the uncalibrated speedometer. If this indeed the case, the speed cannot be used as evidence in court.

are you guys kidding me? "take your ticket like a man"? What the hell is that about. If he has a defense, present it. Uncalibrated speedo, score.

Real men fight their tickets.

Hey,
I have a question I was wondering if anyone could offer some advice.

I went camping with the gf this weekend. We knew it was going to rain but we figured we would tought it out. Well we figured wrong. Everything got wet so we packed up around 11:30 and decided to drive home. About a 2 hour drive.

It was probably around 1:00 or so and I was cruising down a straight road doing 100mph or so. I mean this road was so straight we went for many miles without a turn, no other cars in sight. Around the City of Bunnell I was pulled over. The cop said I was doing 92mph in a 60 zone.
He gave me a ticket but it said "Failure to observe a traffic signal" And he didn't put the fine amount on the ticket.
So now I'm wondering what I should do. Should I try to fight this? I don't really want to go to court. Bunnell isn't very close to me. I know in New York if a ticket wasn't filled out properly it was considered defective and you could get it thrown out. I actually did this in New York twice.

Or should I send a check for zero dollars and claim I fufilled my obligation?

Any other ideas or comments would be appreciated.

Danny

I agree. I drive over the limit very frequently, but drive tactically so I hadn't had a speeding ticket in over 12 years until I got hit for doing 60 in a 45 last year. It was in an area where I knew better (dammit!) but was distracted at the time. I paid up.

BTW, where is the proof that the cop's speedo is uncalibrated?

Does it have any points? If not, pay it. If so, fight it. I always fight. I make those pricks work for their money and not just give it to them. Otherwise they will stick more pricks on wheels whenever they feel they need more revenue.
