Loaner car. ????

I put this up in Tech' Only.....but if your like me, I don't always look in that forum. so , here it is...........


"What's the liability of having a loaner for my customers to use.?

Would like to have a loaner, as I am way out of the way for most of my customer base. I usually run them home when transport just not availabe.
There's no local taxi service here.
However...the liabilities involved need debating.

Owner operator.......seems I might have to incorperate."

Check with your insurance agent about your state laws concerning what insurance would be "primary" in the event of a claim. Out here, the laws are set up so that the customer's insurance is primary, then the shop's policy. I recall a recent case where there were 3 policies in play when a customer hit a pedestrian (out of crosswalk, dressed all in black, before dawn) driving a shop's loaner. It turned out that the customer's car in the shop was insured for up to $100K BI, he had an "umbrella" policy with his homeowners carrier for $1M and the shop was covered with a $1M policy, so there was $2.1M in coverage, but the primary control of the action was with the carrier that had the smallest exposure.
