Where else would it be?

Doesn't the constitution state only what the Federal government can do? Everything else is prohibited? The states can do what they want. Thus certain protections were included making sure that rights were protected.

Only individuals have rights, not groups.

Police have no martial power, martial being a term that refers only to the military. A police chief can request NG from the governor.

The governor is the civilian leader of the NG just as the predient is the civilian leader of the federal troops. The governor can request federal troops from the prez.

Posse comitatus laws were enacted specifically to prevent another president from sending federal troops to enforce civil law within a state without the governor's request. Guess who did that first and got away with it?

That's my point. Unless he is both the Gov and Chief of police, he cannot declare martial law.
