If they won't fix it how do you get out of the contract? What does the contract say? I wouldn't pay them anything else, but get them to stop work as well. Then try to get a refund for the portion of the work they did not do, it doesn't sound like they are 1/3 of the way through.

I hate to say this but if they won't fix it, chances are you will lose some money. Contractors can be tough to deal with, and as said above the can put a lein on your house.
Hatt, my job isn't to enlighten you--but you write stuff like this and it tends to be written like you do 'deals' and hire people all the time, and I don't know, maybe there are folks who may rely on it to their detriment. Telling someone that they can just blow off a mechanic's lien because they can merely go to court and get it removed is reckless, and reflects a lack of understanding regarding cloud of title. Real Estate, 101.

By the way, how was that big business trip you took last month to Brazil? Run into Bush down there?

Glad it appears to have worked out...let us know if they stand by their word!

I never said to blow off a mechanics lein, all I said was its not the end of the world. It will cloud title to the property but they are not going to take your house, and it can be fixed with a lot of time and effort.

The venture in South America fell through, sour subject at the moment.

I find it hard to believe that Oklahoma is the only state that has the "prior, proper notice" clause with regard to liens. Check your state statutes. It was in plain, black and white English and still, 4 of 5 attorneys and 1 judge were not aware it even existed.
