True dat. At the same time, sometimes you have a decent case and the offer is bad and you just have to try it. Its a constant carving out of the settlement ranges, you know? Not to mention, in my county, if your on the defense, you don't want a jury, they'll likely hurt you pretty good.

Here is the question restated then. If an attorney gets paid whether the result is win, lose or draw, how can the client be sure that the attorney is doing their best and being honest in the appraisal of the situation?

I don't know anyone who has been fired and had letters from lawyers advising him to seek an audience with them. I do know that my last two accidents that were not my fault somehow generated a stack of letters from attorneys telling me that I should check with them on my rights. If you own a timeshare, you might get people wanting to sell it for you for a small fee and large profit calling. True, you cannot always ensure that the other person involved is dedicated as you are. However, where I can, I like to tie their future to mine. IOW, the more you have to lose when I go down, the more certain I am that I am getting your best.

In the situation of a lawyer, if their financial health is tied to my winning the case, I feel I will get a more honest answer out of them as to whether my case has merit and how much or whether the chances are good that we will prevail. Otherwise, they might try sell me a wonderful dream and at the end of it, I get to pay the bill whether they win or not. Again, in say criminal cases and what not, you cannot assure it so you have to take your chances. In this case, where I can assure it, why not?

Two thoughts come to mind . . .

In ancient Roman times, when an arch was completed and the last "keystone" was to be placed, locking the arch . . . the Romans assured the best quality work by having the person in charge of the project stand beneath the arch during the process.

Then there's the story about the dental patient that, just before a procedure, grabs the dentist's balls and says . . . "Nobody's going to get hurt, right?"
