A 21-year-old Harris County woman filed a $200,000 lawsuit against American Airlines alleging employees on a flight to Los Angeles from Dallas/Fort Worth Airport failed to protect her while she slept from another passenger who masturbated to her and ejaculated in her hair, according to a lawsuit she filed last week in Tarrant County.
The Harris County woman alleges employees knew of the risks associated with failing to “police the passengers to ensure that passengers do not hurt one another,” the suit states.
Airline officials did not return calls seeking comment. In a statement to a Houston television station last year, a spokesman said the company regretted the incident, but the flight crew took appropriate action.
The woman and her lawyer could not be reached for comment. The Star-Telegram does not identify victims of sexual crimes.
Destined for a Spring Break visit with family and friends March 19, the woman flew from Houston to DFW Airport and had settled into her seat for the last leg of flight 2074 to Los Angeles about 11 p.m., the suit states. The woman slept most of the flight, but awoke about 20 minutes before landing when the pilot announced the plane was on decent into Los Angeles. When the woman opened her eyes, she saw that an unknown man had moved into the seat next to her and was staring at her as he masturbated, the suit states.
The woman turned toward the window in embarrassment and in an act of nervousness began to run her fingers through her hair where she noticed “a substantial amount of an extremely sticky substance in her hair,” the suit states.
The woman began to cry and tried to get the attention of a flight attendant, but was unsuccessful, the suit states. Finally a passenger in the row in front of the woman comforted her and verified the semen in her hair, the suit states.
When the plane landed, employee called airport police and the man was arrested.
The suit alleges that the during the investigation, American Airlines employees told police they witnessed the man move from his assigned seat into the row where the woman was sleeping.
The woman is seeking punitive damages and a jury trial.

I would hope that the flight attendants would kind of try and walk around once in a while and tell naked people yanking it that they shouldn't. At least the guy wasn't a pedophile.

I'm quite sure that the attendants would have stopped such behavior immediately if they witnessed it. I don't believe the airline has a the responsibility to watch out for the behavior of its passengers for the entire flight.

I do wonder about the veracity of the story. It would seem to me that other passengers in the immediate vicinity would have witnessed such behavior.........even if the woman was asleep. Like most stories from the media........we get only about 1/2 the truth.

I don't think the airline is responsible unless the attendants were neglectful. Obviously she's suing them because they have $200K and the guy probably doesn't.

I do think flight attendants should check on the passengers the whole flight on a regular basis.

Well, in previous cases courts have ruled that the police don't have a duty to protect any specific person from any specific crime. If the police aren't responsible, I don't see how the airlines could be.

Just fessing up, I did laugh out loud when I read that story. It's just so ridiculous. Creepy and sick to be sure, but also ridiculous.
Anyone else?

From a practical standpoint, it seems that if it were a long enough evening flight where the cabin lights are dimmed, most people are asleep, and the cretin has a blanket covering himself, he could get away with quite a bit, even taking some of his 'stuff' and manually putting some on her hair without anyone else noticing it being done.

That doesn't make the airline responsible.........it makes them a target of a lawsuit.

The more I think about it..........the more the story cannot be true as described.

He had to be sitting down and covered with a blanket until the finale. That's the only possibility of pulling off this scenario. If this is the situation, the airline could not have detected it..........even if there was a flight attendant walking the cabin continuously.

Indeed. If OTOH, he was exposed, an FA walking around could've seen it. I know that this lawsuit is stupid, but if a passenger were to start beating another one to a pulp, would you expect/require the FA to intervene? An airplane isn't a lawless cabin, yet FA's aren't cops obv.



If there was an air marshall on the plane too, cha-ching! I'd be shocked if her lawyer hasn't checked. We need more judges to dismiss these kinds of cases, or juries to. Instead Law seems to be a game - anything is fair as long as you're clever enough.

Let's say that a very good lawyer convinces the jury that the airline is responsible.

What's the damages?

The person must prove damages if they wish to have any kind of award.

So, she gets one or two shampoos and a styling done and the problem goes away. You cannot convince me........under any possible scenario........that she is harmed for life by such an occurrence and that she's entitled to a large monetary settlement.

So, OK..........airline culpable..........here's your check for $200.........bye.
