What to do about my title?

My 1990 Ford Econoline van is sitting in my apartment complex just rotting with a good engine and a bad tranny. Unfortunatley, when my parents bought the van back in 92' with a loan from the bank, sometime throughout the note, the bank was purchased by another bank. The car was paid off but a title was never issued to us. I think since the van was still in use by my parents, they never really worried about it and now I have it and need to sell it or just get rid of it. The title has a lien on it, but the bank knows nothing of this vehicle, so they are no help in issuing a title or releasing the lien. Obviously with the car not being re-poed, it was paid in full. What can I do to sell this car and get it out of my life?

You can go to DMV and apply for a duplicate title. I had to do that with my VW when I misplaced the original after losing some paperwork from an interstate move.

talk to the DMV. in Ky I have had them drop the lein because it was too old. Nobody has a 10 year loan on a beater.

I'm not sure what bank it was. I'll check out the DMV about dropping the lien in an 18 year old car.

depends what you want for it.if you just want it out of your life and a couple hundred will do.scrap it.iron was up recently i don't know about right now but a buddy got 250 out of an 88 olds.or advertise it on craigslist for parts only.

Well I do want it out of my life and yes a couple hundred would do, but I thought that you couldn't sell to a junkyard without a title?

No as long as you provide them with some sort of bill of sale most will still take it. They typically do pay you more if you have the title though

Ok. I posted the car on craigslist, and have two potential buyers. Both are aware of the title situation. Is it legal to sell a car without a title? Are there any liabilites on me if this guy fixes the car and dosent insure it and hits somebody?

you need some way to notify the state that the vehicle has been sold. I recently sold an audi, the tool didn't register it and kept driving it, and 90 days later i had an impound lot on my ass for storage fees and to come get my vehicle. They would not release it to the gentlemen that bought the car because the officer confiscated the title. Once he retreived the title he was allowed to get the vehicle out. Case in point, without the title i would have been liable for towing/storage fees if he didn't want the car anymore.

Whenever I've sold one of my cars (as a private seller) to someone I thought might not get around to registering it right away, I have always drafted a simple Bill of Sale that we BOTH SIGN. I make two originals, we sign them both. I keep one original, and give one to the buyer.

(Oh, and get their legal name and address on the form...)

I do this in hopes that is is a binding legal instrument that would absolve me from liability once they take posession of the car.

Will it hold up in your state? Heck, I don't even know if it would hold up here in Georgia, but it sure helps me sleep at night after a sale!

By the way, I had an auto loan with a bank that was bought out a while back and was able to get the bank that bought them out to process the lein release. They had to look for a while before they figured out where in the company it could be processed...

well after about two hours on craigslist, I had a slough of callers, but only one showed up to look and we both signed a bill of sale and he assured me that he would pull the motor that day and at this very moment it should be hitting the crusher. He also assured me that he would take pictures to show me that the van would never be on the road again. I hope he was serious, but I'm not worrying too much about it because it really was a huge piece of crap. Thanks to all who replied.
