We were taking an ASA Bareboat Captain certification class on Lake Superior near Bayfield this past summer. We were sailing a 38' boat and my wife was at the wheel. It was race week and we were in the middle of the fleet. It was obvious we were on a collision course with one of the raceboats. Since we were following the commands of the instructor, my wife asked the instructor if she should change course. He replied, "No, you have the right of way, Hold your course." My wife looked at me with a quizzical look because to both of us, given the tack we were on, we both thought the other boat had the right of way. We get closer and closer and my wife finally states, "Are you sure we have the right of way, we're on a port tack?" The instructor screams, "Oh my God!", grabs the wheel and tacks just before we collided.
Needless to say, the instructor wasn't saying much after that fiasco.

Right of way is not followed in imminent danger situations. Size in right of way situations is also not considered by many. In the USA in a narrow passage or fairway vessels over 20 meters have right of way over vessels under 20 meters. The number one rule of life underwater is size equals power. The number two rule is never get injured. Pretty much the same above water....

You would think that on a nice day without anyone around they would figure out how not to hit eachother. I mean I know the rules of the road, but damn their is plenty of water avoid the other freaken boat!

Did you notice the kids on the swim platform at the end? On a running boat! Real safe.

There is no shortage of idiots on the water. Most of the time it's quite entertaining.

Technically you have right away over race boats, but I would refrain from pushing the issue because if you push against the right captain he will make you sweat. Certain guys that I race against have a habit of always taking right of way weather they have it or not. I know one who will not hesitate to pass your 38ft boat with his 45ft boat, 18 inch's off your rub rail.

Oh and crab/oyster/clam boats always have right away, always...they usualy have shotguns....and get grumpy.

Yes it is, I enjoy watching the show on the big weekends when the once or twice a year captains are out.

I was almost hit by an Open 70 off Newport last summer. I was on Stbd, clearly had right of way but the race captains of those whizbang miracle boats don't really give a crap. And no, he wasn't racing, I'm smart enough to stay well clear of the racing. I had to tack away at the last minute. There is an amazing number of idiots on the water. I have had many near misses with powerboats too. How you can not see a sailboat with a 50ft mast and huge white sails is beyond me. How you can expect me to "take evasive measures" when I am making 7kts and your are flying at 30+kts is also quite a mystery. Its also a mystery why, when they entire bay is available, they have to pass with 100yards? RT

It's a mystery to me why the DB's have to pass the ferry within 75' when the entire channel (500 yards) is available. Sometimes they disappear beyond the side of the boat and reappear ahead of it.

Two years ago I had a 14 foot sailor jibe just as I was coming around a bend- just so he could come in front of me and "have right of way". We were in the ICW north of Canaveral. I slowed down but did not give way, and sounded five blasts. He was sailing and I'm on the Donzi. He screamed bloody murder both out loud and on the radio. I have the CFR bookmarked on the boat: 33 CFR part 88 rule 9

(b) A vessel of less than 20 meters in length or a sailing vessel shall not
impede the passage of a vessel that can safely navigate only within a
narrow channel or fairway.

(d) A vessel shall not cross a narrow channel or fairway if such crossing
impedes the passage of a vessel which can safely navigate only within that
channel or fairway. The latter vessel shall use the danger signal prescribed
in Rule 34(d) if in doubt as to the intention of the crossing vessel.

I read it to him and told him to take up knitting with his wife. The next pusher tug I saw called me on thirteen and asked if it was me that quoted the CFR. "Yes sir" I replied. He said that made his day.

I refuse to accept that there are people (and I guess now, at least two) that are that stupid.

Judging from their speed and apparently wide open waters. A few things are running through my mind here.

There was some big egos involved. Perhaps a bunch of alcohol. Perhaps someone didn’t know the rules and was hoping the other did. Perhaps there was nobody in either wheelhouse. Bingo! That’s it !! Nobody saw the other one coming ! Maybe they were playing poker. Yep that’s it. I’m going with that one. The drunk crew was playing poker and not even at the wheel.

I’m going with it because I know that anyone driving that big of a boat knows what that round thing on the bridge does as well as what those levers do. Otherwise, I’ll have to accept that there are people driving big boats around with the IQ of a skink. And I refuse to do that.

Oh that drives me nuts coming into Milford harbor. It gets real narrow and shallow, so with a larger boat your stuck. The GD morons on jet ski's will crowed you over in the channel. At high tide they have all of 5ft of water just outside the channel.

I yelled at a couple when I was coming in on a Pearson 36. I was like I draw just over 6 and can't move, you draw 6in. You can either move starboard or I can run you down.


I guess people just don't know what they are doing. Because at high tide in a small boat I come flying in over the bar and never even get into the channel until I'm in the harbor. The do gooders keep pushing the no wake zone further and further out for no reason, so I just bypass the channel.
