I am not an advocate for illegal aliens, and I grasp some of the issues you bring up. I even empathize with those in Texas who have to deal with the problem head on. But we are a nation of laws, and the law is not being applied correctly in this case. Don't complain here to me, complain where it may do some good. Get involved, get the laws changed, but don't applaud when prosecutors deliberately abuse the law. Did you notice, even with a conservative bent, the SCOTUS voted unanimously? Doesn't that tell you that there is a fundamental wrongness about the actions of the prosecutors using this method? Unanimous, no dissenting votes. Are they all liberal immigrant-loving 80MPH driving SOB's who just don't get it? Or is there a basic element of law that has been warped to fit a need it was never intended to address?

By the way, love the old style Bronks!!

I'm sure that the issue is not half as bad in CO as it is in TX, but I had occasion to be around a fair number of both legal and illegal immigrants there, and found them to be, if anything a harder working segment of society than many US natives.

So what's your point? That the hard work makes up for everything?

Punish the employers, absolutely. Interring the illegals, worthless idea, in fact less than worthless, as it will cost us even more.

Take it off the savings we will get from having less illegals here. Take it from the employers who hired them. But since you asked, yes I will vote for that guy.

Typically, the law is a specific one. And you need to prove they broke it. We call it due process.

The specific law in question requires knowledge, as cited by dculkin. Prove knowledge, win the case. Don't prove knowledge, lose the case.

Regardless of how one feels about illegal immigrants, it is absolutely prosecutorial misconduct to threaten them with one crime to get them to plead to others.

The history of immigration (legal or illegal) in this country is a direct result of labor needs. We need them, they'll be here. Once we don't, the law will turn on them in a heartbeat, as it has in the past.

Don't prosecutors do that anyway when the make a deal with you? Plead guilty to this or go to trial for that?

The law turns on them only when the political heat dies down.

They don't threaten people with murder charges to get them to cop to larceny.

A prosecutor is not permitted to charge a defendant with a crime when the prosecutor knows he or she does not have any evidence to prove the crime, but he can bring a charge that he knows is weak in order to get the defendant to plead to a lesser offense. For example, a prosecutor might have a good faith basis to charge someone with first degree murder, but have some doubt about being able to convince a jury beyond a reasonable doubt. In that case, the prosecutor can charge the defendant with first degree murder in order to get leverage to get the defendant to plead to second degree murder, manslaughter, or some other lesser offense.

In this case, the prosecutors are alleged to have known that they can't prove the knowledge element of the stolen identity statute. If that's true, then it is unethical for them to bring that charge, IMHO.

He had the right to remain silent and force the state to prove its case beyond a reasonable doubt. That's how it's done in America. There is no evidence that the defendant stole anyone's identity. It wasn't "some supreme court justice." It was a unanimous United States Supreme Court, including Justices Scalia, Thomas, Roberts, and Alito. You seem to have a low opinion of that institution. I will grant you that the Supreme Court is not perfect, but it is the best institution of its type ever created and it deserves our appreciation and respect.Somehow I don't think that our Supreme Court could prevent that from happening simply by ignoring the rule of law.
Apparently, you haven't been introduced to the lovely system of tax collectors our government has...or does the above apply only in ... what?

Prosecutors and DAs have used "trumped up charges" in many cases to assist in plea-bargaining to lessor, but more valid, charges.

Nothing to get the panties all in a twist about. But, going the PB route does manage to keep alot of cases out of court that never should be there in the first place...mainly because of bleeding-heart liberal lawyers that get paid from the public trough for doing nothing more than clogging courts with PITA cases that shouldn't be there in the first place.

Illegal immigrant? Deported back to his/her homeland. If he cared for his family in the first place, he'd done alot more than hang out at the parking lot of Home Despot and sneak around for a yob. He'd take classes, learn English, take the tests, get a real SS# and play by the rules...

Instead, we have half-baked citizens that don't even know the Pledge of Alleigence, the Star Spangled Banner anthem or what voting district they belong to, and they are the ones screaming that we need to protect every Thomas, Ricardo and Jose that comes across the border in the middle of the night. And they scream even louder that crime is increasing but don't have enough gray-matter between their ears to put 2 and 2 together to come up with the right answer.

We need real polititians and enforcement officers that will follow the rule of law. We need real judges that aren't driven by re-election fears that will do the job they were elected for and not hide behind the shadow of their robes.

Until that happens, you're going to have more of this type of BS occuring more and more and more.

We don't need them, but they are still here.

I love it when you right wingers call Hispanics, even when the spelling is a joke in itself "discusting pigs". Thanks for the votes!

Of course, now that I have seen your previous posts of links to White Supremist sites, we all know the real reason you think they are less than human and should be put in concentration camps, don't we, hmmmm? And why am I not surprised that the usual chorus jumps in to support you in your crusade to keep the race pure? This is what is left of the right wing in this country, the "fringe".

Law without mercy is useless. These people are doing what they are doing so they can afford a package of hot dogs to feed their kids. The right wing has blocked every attempt to bring these people out of the shadows, of course, no one needs wonder why: The Talk Radio Party loves to whip Jim Crow on the cleaning ladies and janitors, the weak and politically powerless, the voiceless poor, and all so you think it will somehow make your anger go away.

I guess I am missing the connection. To me, one group is there because there was a law that applied to ALL and they broke it. The other was a group that was there because they were of a certain race. I don't see the connection. Maybe you can explain it.

Not at all. Jews were minding their own business and not disturbing anyone except that they pissed off Hitler. Mexicans are breaking the law that everyone is supposed to follow. That means every immigrant whether they are white, blue, yellow or green.

I think the guy was being sarcastic. Unless "Awake" is one of your sockpuppets, in which case you'd be in a better position to understand the intent of his posts .

An amnesty is pointless when there is an endless supply of poor and desperate people living south of our southern border. Once we amnesty or in any way legalize the illegals already here, millions more will rush in to take their places in "the shadows".
