This reader comment struck a chord with me:

Dr. Corbett, I read the court decision. They only said you were in violation of the establishment clause for the "Peloza" comment regarding creationism being "superstitious nonsense". Every other comment which Mr. Farnan objected was deemed permissible by the court. While I completely agree with you, the court made it obvious the issue was not your critique of creationism, but the way you stated it. By disparaging the religious belief as opposed to the "logic" behind it the case had merit (albeit not much).

He acquits himself very well in that piece. The fact that he explained his pedagogy in the letter home to parents reinforces my earlier view that this is not simply about protecting poor Chad. If Chad needed his religious rights protected, he or his parents could have dropped the class. This lawsuit was about trying to stop critical thinking and religious and national myths.

How many non-religious creationists are there? It was precisely the connection between this superstitious nonsense and religion that the teacher was pointing out.

It's the teacher's blog...his viewpoint on his statements...he lost in court on one point and he's still begging for a fight.

His point is that he's right and the kid was wrong...

A judge threw out 19 of the 20 comments made by him and one stuck...if 5% pisses him off this much, I think he "pooched it" for the rest of the teachers in Califonication by pressing the matter to this point and beyond...

Now, who's looking more like the idiot?

Perhaps if that's all you see from the facts and decision in this appeal, then perhaps myopia exists on both sides of the debate.

X2. I think little Chad is a whiner and I'd like to know why he isn't in a school that goes along with his train of thought?

This case parallels very closely the anti-blasphemy resolution being pushed by Muslim states at the UN.

I find this very interesting using fear and intimidation as a base for a religion to control it's congregants/followers. The only thing religion does is explain death.

It's the only point that matters.

Correct.

The kid. His parents, and their cult. Judge too for that matter. For allowing the one point to stick.

I was thinking that as well. Given the inherent invalidity of religion, the only way it can survive is by being afforded some officially sanctioned protection that it doesn't deserve and without which it will be justifiably mocked.

Because, quite simply, we tax citizens for the right to have access to public education. Whether public education includes casting aspersions on religious or philosophical points of view was the issue in the case.

If there is disagreement, shouldn't public school teachers make it a point dispel the belief in Santa, the Easter Bunny and Channukah Harry by the kinder?

I have a feeling this would have happened even if this kid was in a private school.
