Proof that Right Wingers hate free speech...

As long suspected but, until now, never proven....

I have no way to prove the Judge is a right-winger, but, like many a right-wing E-Mail I receive I can say, "I don't know if this is true, but what if it is?"

Note 2: Bexar is pronounced like 'Bayer', the aspirin, and not like Ba-zar with a long a and then a short a.

Right-wingers against free speech? A judge shutting down nudie-clubs for violating legitimate injunctions?

It's like the American-African screaming that it's unfair and against the law that he's being arrested for just being black when, in fact, he's still holding the knife he used to puree his victim with.

This story is a stretch, at best, for the tittilation effects. It has nudes, law, contested court procedings and the related minutia...but nowhere does it scream "RW-Justice Stomping On The Rights Of The Little Guy" in any shape or form.

Odds are, the "mob" down there is calling in some newspaper-favors and trying to tear a new a-hole into the judge and his peers.

It's election season, isn't it?

I read somewhere that Houston, TX has a local ordinance that requires the dancers in strip clubs to always have ID on them while at work . . . what a job, being the inspector to enforce that law, that must be.

Totally neked dancin' illegle here in my state. Yo nips gots to be cuvered where alcohol is sold. The ladies can bare 'em in "juice bars" tho.

That is actually the law in Texas too, all-nude clubs operate on a BYOB basis only here. If alcohol is served, the state can regulate whatever activities take place on the grounds that it needs to do so to maintain public order.

Since no alcohol is served in these joints, perhaps the judge can tell us all what the state's compelling interest is here ? I see none. This one will be overturned.

The article plainly states that the club's attorney says the ruling has a 'chilling effect' on free speech.

If they are chilled then why don't they put on more clothes?

Are local judges elected in TX or appointed by the municipal governing body.?

I receive a lot of E-mails from right wingers that start with, "I don't know if this is true, but I wanted to pass it on anyway."

I clearly stated in my initial post that I did not know if the Judge was a right winger or not. But the odds are 1 in 5 that he is.

Are right wingers the only ones that can send out totally bogus stories with eye-catching titles?

On a serious note: Are indoor shooting ranges covered by the First Amendment? I realize this question is stupid, but one of the logic bending e-mails I received went into this very subject.

All Judges in Texas are elected if they are state or local. This is in the Texas Constitution to keep the Gov from packing the court with his friends to reward them for service.

That was common in the early days of the state when Judges were appointed.

Free speech ?? In what regard?? Location? Seems to me that would likely be a zoning issue of what the town wanted to permit as a use and where it would go. Or am I missing your point? What's the yahoo's beef?

Zackly the opposite here. All judges are apointed. State Supreme, Appelate and Superior Court appointees are appointed at the state level but filled with local (county) attorney's. Municipal judges are appointed annually at the whim of the governing body.

So, am I correct in assuming this facist judge represents the thinking of those who elected him?

From the days of burlesque to lap dancing . . . the US Supreme Court has, over the years, found that nude dancing is a form of artistic expression which can be afforded Constitutional protection, subject to competing governmental interests of zoning and public/private conduct.

You are missing the point.

The strip clubs lawyers are pushing this as a First Amendment thing. The Judge was only going by the city's laws since he is not the Supreme Court.

It is the reporters in Texas that are laughing over this. Right wingers say the most outlandish things and then hide behind the First Amendment when it blows up in their faces. Ask Dr. Laura how that works. Now the strip clubs are using the First Amendment and the right wingers really are saying this has nothing to do with free speech.

In Texas this entire situation is being treated as a joke. The Blue Nose wing of the hard right insisted the city's laws on this be passed about eight years ago. The fact that the law is clearly unconstitutional is of no importance to them. Getting their way is.

About 25 years ago the same type of thinking by the hard right led to a bond election to spend $2,000,000 in McGregor Park outside of Austin since they did not like the park. They thought if a bond election were held to improve he park and it failed then they could use the failure to justify shutting it down.

It passed by 80%, so Travis County had to spend $2,000,000 to improve the place. Google 'McGregor Park Lake Travis' and you will see why they wanted to shut the place down.

The big question is: Will the forces of good and/or evil (depending on where you stand on the subject) prevail?
