Problem with Progressive Insurance

I've had Progressive for almost four years and have been happy with their rates and the fact they will provide collision coverage on old cars.

I'm about to get crossways with them. My significant other was stopped at a red light and got rear-ended by an old geezer in a jacked-up pickup with a winch on the front. The winch took out the bumper and hatch-back on the car.

We called Progressive and they were real positive. Based on the facts, they were going to pay for repairs and get the deductable from the other guy.

Today they got the full information. The old geezer also has Progressive insurance. They say that since old geezer has not reported the accident, it may be a year before they cover the deductable. In the meantime, I have to pay the deductable ($1000) and wait on them to decide when to pay it.

A lawyer friend says it will be better to sue the other driver than wait on Progressive. What do you guys think?
