If I'm sitting in the Car in the Driveway (WITH THE KEYS NOT in the Ignition) [Especially if the Officer has not observed me Operating the Vehicle!] I'm pretty much BulletProof from a Moving Violation Citation. Analogy would be a Vessel at Anchor. However,If Someone were speeding (Or any Other Violation on Public Roads) and pulled into their driveway... Someone's gonna get ticketed... Of Course,Common Sense applies...Argue with the Jurist(JUDGE). Not the Officer. What's the end result? |

Private driveway is no different than a business's parking lot .If the officer is in pursuit (no, not lights flashing and sirens wailing) and the vehicle in motion then, yup, it's legal.
It's different if you're sitting, engine off, in the vehicle and then they roll up. |
I had a new local leo come here years ago. He came right down to the house (1/2 mile off the public road). He was being a bit smart so I got one of my drivers to park the scraper across the drive. The leo soon realized he had a problem, no other way off the property. It is a couple of days walk back to the station. After being told that he would need a court order to collect the car, he calmed down & tried to be friendly. He moved from the district about 3 months later. It helped that the district superintendent was a good friend from Rotary.
I wonder in the OP's situation if he had been followed home? Maybe going a little fast? Could they have been just wanting directions? |
