Man, you gotta go through your inbox a little more frequently...

That email came out weeks ago.

Wouldn't have made a difference if Arnie was born here.

I believe that's what the hubbub is about. If you are born in the US, the citizenship of your parents is irrelevant. That's why Rubio's name is being mentioned as a VP, unless of course you are a birther then Rubio is out as well.

Rubio is not a natural born citizen.

BTW, your use of the phrase 'birther' has no applicable context with this argument.

According to the 2011 Congressional Service report and until the SCOTUS says other wise:

Quote:
The weight of legal and historical authority indicates that the term “natural born” citizen would mean a person who is entitled to U.S. citizenship “by birth” or “at birth,” either by being born “in” the United States and under its jurisdiction, even those born to alien parents; by being born abroad to U.S. citizen-parents; or by being born in other situations meeting legal requirements for U.S. citizenship “at birth.” Such term, however, would not include a person who was not a U.S. citizen by birth or at birth, and who was thus born an “alien” required to go through the legal process of “naturalization” to become a U.S. citizen.

That's because it is not governed by the Code. It is governed by the Constitution. His quote is from this report- http://www.fas.org/sgp/crs/misc/R42097.pdf

Here is what the Supreme Court had to say about it in 1898 - United States v. Wong Kim Ark - AFAIK, that is still the law of the land. The thing I love about that case is that it gives the middle finger to all the xenophobes who can't stand the idea that all those brown-skinned anchor babies are just as American as they are.

As I said earlier. The birthers seem to be the only ones unable to latch on to this concept and why Rubio's name is being bandied about for VP slot. No one except the birthers seem to have an issue with him being VP.

Why don't you post the dissent in Ark vs Wong.
And its not 'the law of the land'.
Maybe you can show a direct challenge where SCOTUS defines a natural born citizen, not some lawyers opinion on citizenship?

Just for clarity, the dissent opinion IS available in the link to the case, but I guess you must have known that.

What was it in the dissent that you believe is persuasive?

I thought we were talking about what the law is, not what some justice in the minority thought it should be.

Maybe you could explain what you mean. I'm pretty sure that you are wrong.
