I have a story that's similar. I have a bunch of cars, mostly seldom driven vintage cars. I'm forever in need of fresh batteries, because I always forget to set up the chargers. One day, I spot someone offering two AGM batteries for $100. He had bought the batteries for a truck or motorhome, and it was wrecked before they were installed. It seemed too good to be true, but what the heck. So I bought the batteries, and paid another $50 to have them shipped. A few weeks(!) later, I was surprised when UPS delivered a crate from a well known TV ministry (name withheld). Inside, were two of the grungiest batteries I've ever seen. I mean, these things must have been fished out of a mud hole, then rinsed in swamp water. Not only were they dead, the were nonchargeable. So I wrote the seller and said, here's what we both now know. 1) You sold me two useless batteries and 2) You stole the postage from a church. (I'm not religious, but there has to be some commandment about stealing from a church). He said that the batteries were perfect, but he'd happily return my money if I returned the batteries. That meant another $50 shipping charge. So I filed a claim with paypal. Paypal said that as long as he was willing to take them back, it was my responsibility to ship them. I dinged his feedback, and returned the batteries. My total cost for the batteries and two way shipping was $200, but at least it I would recover $100. It took Paypal months to get the money back for me. And when it was all over, he filed a protest with E-Bay, which converted my negative feedback to neutral because he had returned the cash. This was some years ago, policies may have changed, but I'm still very cautious.

Today I printed the label from Ebay and am shipping the crank back. The seller has filed a case though so I don't know what that means. In any case I am shipping the crank back and am not out of pocket for that at the moment.

The seller in his communication with ebay argues that the crank looked good without any discoloration etc. but did not claim to have measured it.

In my argument I state that my machinist measured it and found it was too small to buy bearings for....meaning that none are available for the size it would end up at if turned.

We'll see.

t wagamuth, what are the seller’s stated terms for sale? You can find that by going back to the item number for the sale.

The only times I had a problem with an ebay seller is when I didn’t return something quickly enough. Sellers are required to have stated terms and as long as those are maintained everything has worked out okay. I did compalin to ebay once and they helped me despite the seller's objection.

I’ve never needed to complain to my cc vendor about a bad ebay purchase, but I always use AMEX, just in case. AMEX has never failed me for buyer protection in general but I don’t know if that extends to ebay purchases.

So, does this mean that now if a seller includes "no returns" in the sales ad, that is no longer valid? Lots of old stuff gets sold on ebay, "as is". Not in your case, Tom, as I certainly would think it reasonable to mic a crank or such before posting it for sale.

Today ebay said they ruled for me. I presume that I will receive a full refund. But having paid through paypal they may take a fee.

I dont think so. Even though ebay ruled against me once, I called paypal and they reversed the decision. I got my full money back no fees. Weird considering they are the same company..

Ebay and Paypal have had an interesting business relationship over the years.

They were initially two separate entities, then combined, now are separate once again.

If the crank was pulled from a running engine- no matter how poorly the engine ran- then Tom has no case whatsoever as the seller appeared to claim nothing other than that- from the information listed in this thread. Tom's claim is that the one area is too small to allow a engine to run using this crank has not been verified by attempting to install the crank and start an engine with it. A competent judge would not allow a return with the information from the thread and tell the buyer to be more aware next time.

I guess 'from a running engine' is not much of a claim. You could have a blown piston and the engine still 'runs', would it be OK to sell that piston as 'from a running engine'? If you mean to imply that the part is OK, which is really what it means to say that ....

All used crankshafts are from engines that ran. At one time or other. There is also the change if that journal originally was a real mess. The past user at one time located a bearing from something else and had the damaged journal turned down for it.

The seller is not being ethical anyways. He should have waited until the crank was returned and measure it himself.

Toms machinist indicated it was around 125 thousands under. That by common convention is not a usable crankshaft other than having the journal built up and reground. Besides it being undersized I wonder what that journal looked like and measured at different points.

Actually I have had the original crank now welded up and reground. I'm picking it up on Monday in Terre Haute.
