Superior Court Judge Linda Krese said Thursday she could not sentence Varela to more than two years and 10 months because it was the most prison time permitted for someone with no prior criminal record, the Daily Herald reported.

I wonder if DAs would have pursued harsher charges if the defendant and victim didn't have Spanish names.

Maybe but I doubt it. It's the way the system works. Victimless crimes garner 10 - 20 years sometimes while sociopaths like this get a slap on the wrist.
