Jury awards Florida girl $800,000 to compensate for second-degree burns…
… from a Chicken McNugget that fell on her leg as her family pulled away from the drive-thru window.
https://www.businesstoday.in/amp/latest/world/story/florida-jury-awards-8-year-old-girl-800k-due-to-mcdonalds-burn-injury-caused-by-chicken-mcnugget-390770-2023-07-21 Wowsers. The woman who sued McDonald’s for the hot coffee injury had third-degree burns. And I can testify that McDonald’s coffee is sometimes way too hot but that’s different. Hot water can burn a big area in a hurry. But a small second-degree burn? Her lawyers were seeking $15 million. Well, of course they were.

This is a lot of money for something that only seems partially McD's fault. I guess we'll see if the judge reduces the award amount, similar to the coffee incident. This is why anything and everything has warning labels.

I didn’t plan on sounding like a conservative. But this is more of snowflake America. The girl is now about seven I think. She says she wants to have the scar surgically removed. It’s on the inside of her thigh. I’m just sure it’s going to hold her back in life. I think $10,000 would be too much, but would at least be someone in the realm of reason.
Prolly it will be reduced. Can you imagine being forced to sacrifice part of your life just to sit on that jury? I would be ready to shout at the lawyers and the plaintiff big time.

The US has an extremely litigious culture, in part because we allow direct to plaintiff advertising and in these types of cases the lawyer usually only gets paid if they win. That makes the lawyer very aggressive and there's no or very little risk for the plaintiffs to go for it.
I think it's more a case of "don't hate the player, hate the game".

As I recall reading, in the Mcd affair, the restaurant was aware of the excessive heat of the coffee. Having said that, don't place a hot liquid in a styrofoam cup between your legs. I always have a spill proof container in my car for stuff like that. Perhaps a penalty was inorder but at best a $100k IMO.
I have not read much about this case but the fact that the food is fried in hot grease is not a family secret. Kids drop things. Either don't eat in the car or accept.the consequences. Put a freaking napkin in your lap. Barring willful negligence from McD, this should have been kicked to the curb I agree with Savas that we are a overly litigious society and the courts are helping enable this.

They should not serve food that is hot enough to cause burns. You want to blame a child? Shame on you.

Not blaming the child at all. Blaming the parent. I want food that is "hot". Not into eating a tepid piece of meat. If you can stick your finger in a cup of coffee and not burn your finger...it's too dam cold. Just my opinion.

I want to blame the lawyers who originally asked for $15 million.

The lawyers asking for 15 million?! Goddamned morons! No small amount of the fault here has to do with the whole drive-in eating culture. I would trade a small scar on my inner thigh for $10,000 in a heartbeat.

What I find disappointing is that there didn't seem to be any follow through with McDs. Is a one off $800k judgment enough to change anything? Have any corporate policies changed regarding this issue? Sometimes if I'm driving very late, McD is the only place open to get coffee and most times it is lip burning hot - way hotter than any other place or home. It really seems like something the health department should be on top off.

I imagine they did change their policies.
I have never noticed their foo being too hot.

I have had incredibly hot coffee a few times from McD’s. I don’t buy it anymore.
Anybody remember the great severed finger affair at Wendy’s? Some woman claimed she but down on a finger that was not hers in a bowl of chili. Turns out her husband bought it from a coworker who lost it in industrial accident. Unfortunately for them, it did not show signs of the savory juices normally found in Wendy’s chili which means therefore then it was not cooked with the chili. God only knows how many copy cats are going to come out of the woodwork, perhaps burning their precious children ahead of time to try to prove the claim. God only knows what happened, but $800,000 is way too much. People languish too long waiting for justice for actual issues that need court time for court time to be wasted with this. This should’ve been handled out of court with a modest sum.
