Then I met with a factory rep ... and that meeting resulting in a brand new ML.  Maybe you could try the bypass trick if the local dealer still wants to stick you with a $6k repair that seems to clearly be a factory problem.  I found the MBUSA/MBNA rep to be a whole lot more impartial than the dealer-service manager.  The service manager just wanted me out of there ... the factory rep wanted me to be a satisfied owner.  The problem is that I already paid $6K for the repair following the lawyer recommendation (note: the lawyer who won the class action slugging suit against MB). So I am waiting for him to proceed... might take another month. 
The local dealer told me that the MB rep visited the dealership and checked the engine prior to its replacement. Now the engine is replaced, so I am not sure if I can talk to any MB rep. I do not think MB cares about me being a satisfied owner...
