If you are not getting an oil low message periodically too, then you probably don't have a problem with the oil level/quantity sensor. Mine has needed the sensor for 2 years, and I have the sensor in hand, but I just haven't taken the time to do it. It will show oil hi one minute then -2.0L a few minutes later. And it is very sporadic. It sounds like you may have a little too much oil - its not really a big deal. Make sure your indie is draining all the oil and adding only 8.5 quarts. I do my oil change in my ML320 myself - its the easiest oil change to do of any vehicle I've ever owned.

Make sure the add only 8.5 quarts, my dealer was adding 9 quarts, it ticked me off!!

I agree that it's probably a bit high, it will expand a considerable amount. I'd take a wait-and-see attitude.

I have a brand new oil sensor sitting in my parts stash that I would sell for the same $25.00 plus shipping that I paid for it. It is somewhat of a pain to do as I understand it, but not terribly so. Basically, you need to have a couple days to spare and the proper sealant for the lower oil pan. If you do a search you can find the Loctite number for the sealant, or e-mail Fastlane and I'm sure they it. Drain the oil and let the car sit overnight (oil contamination will make the sealant not hold properly). You have to remove the bolts for the lower oil pan cover and then you need to take a cherry picker/overhead hoist and pull the engine up some (you DON'T have to take anything loose, you are just getting clearance to take the lower pan cover out). The sensor is swapped out, lower pan and the upper pan are cleaned off, sealant applied to make a gasket, bolts installed, oil in, and you're done.

Oil level sounds hi literally
I had a simalar experience and drained some oil - and it went away.
