BTW, take cash ONLY. No money order, check, etc, etc. Remember, a bad check is worth the lessor of 3X the face value or $500 but only if you collect. With her making $200 a week, assuming she has no garnishments, you will be doing garnishments for a long time since it has a short lifespan. Each time you garnish you have to spend another $92.50, IIRC. You cannot turn it into a garnishment without going to court so..... You cannot drag her t court without having the Sheriff serve her so......

It was her fault and she has insurance it seems. No deductible.

Not sure. I didn't read that. Nothing I read says he got her insurance information. But it is late and I am tired so I might have missed it.

To the OP.What is your deductible? Please clarify. Are you talking to your insurance? Why is that? I thought you should be filing a claim with HER insurance? Does she have insurance?

I assumed since he has a police report corroborating there was an officer on the scene who would have recorded both of their insurances.

If he didn't that was a very poor decision.

Nate, you should have gotten out of the Jeep, fallen down on the snow, went to the hospital for a "check out" (different from a "check up") and waited for the chick's insurance company to contact you...any hospital visit is a 5-figure payout with the insurance companies. You could have coughed, squinted, pissed your pants, farted "Yankee Doodle" and that would have had the cop making sure you RODE to the hospital in an ambulance...those suckers are a $1K just to start the engine and turn on the lights/siren.

You missed it this time...next time...just fall down.

I remember something my "X" mentioned when she got rear-ended at an arterial a few years back in the W123 (while we were still married... )

The driver that R-E her came up and started screaming at her as if it was her fault that she was being too cautious about the intersection...then immediately asked that she not call the cops (a GOOD CLUE here that all is not what it seems and fairy tales will spring forth) and that she'd pay for it.

WRONG MOVE.

The "X" went into "panic-mode" when the gal started cranking on her from moment one.

Bottom line?

"X" still called the cops, cop shows up, nails "bi*ch" for driving while suspended, expired plates and a few other items we didn't care about...plus, her son was busy trying to "wipe" the back of the car off...cop gave the kid some sort of ticket...ended up hauling him off due to an outstanding warrant...sometimes, it pays to keep the mouth shut.

The insurance company (her's) ended up paying out just under $7,000.00. After the medical (yep, "X" had a panic attack, got an ambulance ride and GOOOOOOD DRUGS to get her through the week...), her attorney's bits and a bit of polish on the bumper, she had a decent payday...mid-4 figures.

In your case, it looks like she might have had insurance, but let it lapse or expire...if you're lucky, it's still in the "window" for re-instatement...otherwise...let your insurance company eat her alive...

BTW: I'm checking on the "No Fault" aspect...I'm pretty sure Wisconsin still has that on the books, but I'll stand corrected once I check with my agent later today...she's (obviously) more on top of stuff like this than I am. But then, again, I haven't had a "fender-bender" like this in a LONG time.

(DAMN IT! Now I've said it! Murphy's got my nutz and ear-hole in the cross-hairs right now!)

I am joking...and yes...I know about the fraud and criminality of doing so...and the increased premiums. It's just the way the insurance companies settle cases that makes me wonder who really is committing the fraud...they screw you right away or screw you SLOOOOWWWWLLLLYYYY....over time...with higher premiums and lower protection.

Just a comment on the times...

If your deductible is 1000 and the estimate is 800, you won't be getting much, and if it's a no-fault state they won't be going after her. So why did she care if you went to your insurance company?

Unsure where the no fault rule was found. Minnesota is no fault, Wisconsin is not. Called my insurance agent, she was on it like a bloodhound.

My insurance agent asked me if I was hurt, I explained the story. She stated if I'm still sore go in, and I'm not so I said I'm ok. She attempted to contact the other party, who then said she had the wrong number. My agent called me back, confirmed the number, looked her up in the phone book, and left messages on both machines. With my permission, she told the lady, and her boyfriend, that any further contact with me would receive harassment charges and a visit from the local PD.

My ins said to get a 3rd estimate from their 1st call shop, which I did. Their estimate included a new tire (skuffs on the sidewall) and was almost a grand... Covered all the bases that the other shops did with about 10% more for labor (without seeing or knowing about the other estimates) but offered a free rental car.

My ins contacted her ins, who stated they could not find her current policy, and will call back within 24 hours to confirm. My ins said if she's not insured, get it fixed, and they will sue her, at no charge to me.


On a side note, I finished my uncles car today, and they can stop driving their suburban around except as needed for towing.

Just another day in paradise.
Glad to be back home, and it was a beautiful day out.
