I am going to drop away from your thread as you have in my opinion either gotten some decent advice from a lawyer without declaring himself one. Or a couple of guys that at least seem far more knowedgeable than myself.
Being a canadian I have absolutly no experience with the american legal system. Add that I am a fairly simple guy to the equation. So it is very uncomforatable for me to even attempt to suggest things. There are bound to be differeances between the two legal systems. From a canadians legal perspective you have a very good case unless there is something we do not know that could impair it. You have activated your lawyer and hopefully he can remove your stress on this situation. There are things in our system to discourage litagation just because they do not want the american situation. Your system at least may be far easier to use. Naming anyone in sight tends to get things in motion from what I have observed even here though. Once this thing gets moving you should feel better.Hopefully you can state it is resolved sooner than later. Remember it has elevated from a miserable general annoyance to taking what sounds like some pretty expensive costs to repair. Also since it cannot self correct you do have to do something in my opinion. Our building services like inspection planning etc are pretty strong in our area. They see something and they just act. Usually giving you a chance to do what they expect first in a reasonable time frame before getting really serious.Still from the get go they have issued a written order to do so. Running and hiding is not an option for them to engage.In fact instead they are fairly aggressive. Here it is simple applied logic. They do not want to be involved in legal issues and I suspect they like the power they have. It is steadily growing. |

I so want to see a happy ending to this! We had a similar situation where a new upstream neighbor decided to clear all the woods on his property. Not having been there for several storms, he didn't realize the vegetation absorbed and diverted the water flow. So he then planted several dozen pines which all died. Now the water just comes rushing through. Some people are completely clueless about nature and just want a certain look. Luckily we have big pipes under our driveway that can handle the runoff pretty well. If I had your situation I would be on everybody's case about it, nonstop.

Well, Everything was fine when that was covered in trees, 130ish trees came down to make room for that... house..
